In these terms, “we” and “us” mean GALAXY MOBILE SRL, and “you” means the business that buys from us.
2. Scope
We sell only to professional customers. These terms apply to every order placed with us, online or in person. Your own terms and conditions do not apply unless we accept them in writing. By creating an account or placing an order, you accept these terms.
3. Trade account
You need an approved trade account to see our prices and place orders. We review each application and may refuse it without giving a reason. You must provide accurate information, keep it up to date and keep your login details confidential. You are responsible for all orders placed with your account.
Our prices are reserved for approved customers. You agree not to publish them or share them outside your business.
4. Products and prices
We describe our products as accurately as possible. Photos are for illustration only: colours and small details may differ.
Brand names such as Apple, iPhone or Samsung are used only to indicate compatibility. Unless the product page states otherwise, our parts are not manufactured or approved by these brands.
Prices are shown excluding VAT. The price that applies is the one shown when you place your order. We are not bound by obvious errors in prices or descriptions.
5. Orders
There is no minimum order amount. A contract is formed when we confirm your order by email. All orders are subject to availability. If a product is unavailable, we will inform you and refund any amount already paid for it.
You may cancel an order free of charge as long as it has not been shipped. Contact us as soon as possible.
6. Payment
Orders are paid before shipment, using one of the payment methods offered at checkout. Orders collected at our warehouse are paid before collection.
If we issue an invoice with a later due date, any amount unpaid on that date automatically bears late-payment interest at the rate set by the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, plus a fixed compensation of €40 for recovery costs, without prior notice.
The goods remain our property until they have been paid in full.
7. VAT
VAT is charged according to Belgian and European VAT rules. Deliveries to a business in another EU country with a valid VAT number may be exempt from Belgian VAT (reverse charge) if the legal conditions are met, including proof that the goods have left Belgium. We may check your VAT number, for example in the European Commission’s VIES system.
8. Delivery and collection
We deliver to the address you give when ordering. Delivery times are estimates and are not guaranteed.
The risk passes to you when the goods are delivered to you or collected by you.
9. Checking your delivery
Please check your parcel as soon as you receive it. Report any visible damage, missing item or wrong product within 48 hours of delivery, with photos. After this period, the delivery is considered accepted for these issues.
10. Returns of products without defects
You may return a product without a defect if you tell us within 7 days of delivery and send it back within 7 more days.
The product must be unused, not installed, complete and in its original packaging, with its protective films, seals and labels intact. Return shipping costs are paid by you.
Request your return from your account. After receiving and checking the product, we will refund you or issue a credit note within 14 days.
11. Warranty
Our products are covered by a warranty of [6 months] from the invoice date against manufacturing defects.
If a product is defective, request a return from your account. After checking it, we will replace it or, if that is not possible, issue a credit note or a refund.
Please test every part before final installation, for example before applying adhesive or closing the device.
The warranty does not cover:
- damage caused during installation or removal, such as torn or bent flex cables, broken glass or pressure marks;
- physical damage, liquid damage or incorrect use;
- products modified or repaired by anyone other than us;
- products with removed or damaged warranty seals or labels;
- differences in colour, brightness or power consumption that are normal for the quality purchased;
- messages displayed by the device about non-genuine or unknown parts;
- labour costs and other repair costs.
12. Liability
Our total liability for any claim relating to an order is limited to the amount of that order, excluding VAT. We are not liable for indirect damage, such as loss of profit, loss of customers or business interruption. These limits do not apply in case of fraud, intentional misconduct or gross negligence.
Any claim must be made within one year of delivery.
13. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, such as strikes, carrier disruptions, supplier shortages, natural disasters or government measures.
14. Suspension and termination
If you do not pay on time, or in case of bankruptcy, insolvency or a similar situation, we may suspend or cancel current orders and your account, without court intervention.
15. Personal data
We process your personal data as described in our Privacy Policy.
16. Changes to these terms
We may update these terms. The version published on our website when you place an order applies to that order.
17. Governing law and disputes
These terms are governed by Belgian law. The United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention) does not apply. Any dispute falls under the exclusive jurisdiction of the courts of Brussels.
